IMPORTANT CONSUMER NOTIFICATION: It is important for consumers to understand that grading and certification by Numismatic Guaranty Corporation does not guarantee protection from common risks associated with a market which is potentially volatile. The degree to which coins graded and certified by NGC are liquid will vary according to market conditions at a given time for the individual coin involved. For some collectible coins there may, at times, be no active market.  

NGC GUARANTEE

The grading of coins is subjective and solely reflects the opinions of the NGC graders. NGC guarantees that all coins submitted to it through any tier shall be examined by a minimum of three NGC grading experts in accordance with NGC grading procedures. In the event that any owner or subsequent purchaser of an NGC coin believes that a coin has been over-graded by NGC with respect to such procedures, such person may submit the coin to NGC through its "Appearance Review" service for a review of the assigned grade. If the grade determined under such review in NGC’s sole opinion is ultimately lower than that originally assigned to the coin, NGC shall, at NGC’s option, either exchange the coin in question with an equivalent coin at the earlier higher grade or pay the difference between the current fair market value of the coin at the newly established grade and the current fair market value of the grade originally assigned to such coin. Due to the volatile nature of the coin market and Internet auctions/sales, the selling prices in these auctions/sales do not necessarily represent the current fair market value of any particular coin. NGC will determine the current fair market value of a coin based upon what NGC believes, in its sole opinion, to be reliable current market information. NGC’s subjective determination of fair market value shall be binding on all parties. Removal of a coin from its NGC holder, or tampering with the holder, nullifies this Guarantee. If requested, NGC will remedy any clerical error with respect to the description or grade of a coin on its label, free of charge.

WARNING: THIS GUARANTEE IS LIMITED.

1. Oxidation can continue to occur after sealing, and copper coins are particularly susceptible to this problem. Therefore, the NGC Guarantee does not apply to the grading of copper coins.
2. Pattern coins and coins graded under the VarietyPlus and Mint Error services are guaranteed for grade and authenticity only.
3. The NGC Guarantee does not cover coins which have been graded by NGC but then are subjected to abuse, alteration, or improper storage conditions such as (but not limited to) extreme temperature, moisture, damaging environmental conditions, excessive light, excessive motion or vibration, or any other extreme conditions.
4. The NGC Guarantee does not apply to coins that have been removed at any time from their original NGC holder, or to coins with tampered holders.
5. The NGC Guarantee does not apply to clerical errors on the label.

THE NGC GUARANTEE TAKES THE PLACE OF AND SUPERCEDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED AND WHETHER OF MERCHANTABILITY, FITNESS OR OTHERWISE. THE REMEDIES PROVIDED IN THIS AGREEMENT ARE EXCLUSIVE. EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, ALL OTHER REMEDIES AGAINST NGC, INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, PUNITIVE, AND INCIDENTAL DAMAGES, ARE WAIVED.

NOTICES REGARDING NGC'S CENSUS REPORT

The utilization of the NGC Census Report as a tool for assessing the population and value of certified numismatic coins in any character or grade is unreliable. The following characteristics inherent in the marketplace undermine the accuracy of this Census Report.

1. Inexpensive coins which are not commonly submitted for certification appear scarce in this report, but are in fact not scarce.
2. Numismatic coin certification services are predominantly utilized for coins of a higher value or for coins which have an appeal to collectors, and/or generally of a higher grade.
3. Certified coins are often removed from their holders without notice to the grading service, or can be lost or destroyed. Therefore, computer tallies utilized to publish grading population reports may be misleading.
4. Rarity is only one factor which must be weighed in determining the market value of a numismatic coin.

NGC makes every effort to maintain and publish accurate information concerning its grading and certification service but disavows any responsibility or liability regarding the accuracy or the complete nature of the information contained in its Census Report. Numismatic Guaranty Corporation encourages all coin collectors and investors to seek the counsel of qualified numismatists familiar with the certified coin market before making a purchase based on this report.

4. While PHOTO PROOF™ is made from the highest quality materials, it is a photographic product and as such, extremes of temperature or humidity or harsh lighting with ultra-violet radiation should be avoided.
5. NGC cannot warrant or represent that the quality of PHOTO PROOF™ photographic images can be maintained forever, as technology utilized in the PHOTO PROOF™ process is relatively new and the long term effects of the environment upon these photographic images is unknown.
6. PHOTO PROOF™ photographic images of coins within non-NGC holders may not be of the quality of images of coins within NGC holders due to technical differences in design or materials utilized in the encapsulation process.
7. The submission of a non-NGC graded coin through the PHOTO PROOF™ process shall not be construed as a validation by NGC of any grade certified by a non-NGC coin grading service. Such grade is reproduced as a service to the customer only.
8. Historical data contained herein is the best available to date of publication. NGC shall not be responsible for any new subsequent information that may tender previous historical data incomplete or inaccurate.
